THE OFFENCE OF MUTINY AND LIKELY DEFENCES

Mutiny is the most serious of all forms of indiscipline in the military. There can be no conviction on a charge of mutiny however, if the act that constitutes mutiny does not expose the absence of discipline in the accused. The CFRN 1999 (as amended) which created the Armed Forces of Nigeria has equally created enabling environment for operation of the Armed Forces by providing for restrictions on and derogation from breach of Fundamental rights of military personnel because the safety and existence of the Country is greater than the Fundamental Human Right of any individual.
